A jury found appellant guilty of an assault with intent to murder Leroy Wilson by shooting him with a pistol. The court sentenced him to imprisonment for three years.

There is no conflict in the evidence to the effect that defendant shot the alleged victim and that the wound caused him to be hospitalized fifteen days. There is definite conflict between the testimony of witnesses for the State, particularly the victim...
