OPINION

NICKERSON, District Judge.

Defendant was indicted for possession with intent to distribute of 230 grams of cocaine, in violation of 21 U.S.C. § 841(a)(1). He moves under the Fourth Amendment to suppress evidence seized at Apartment 1G, 139-55 35th Avenue, Flushing, New York (the Apartment), in which he had been living.
