Defendant-appellant Robert Lee Holleman was charged in a two-count indictment in Lake Superior Court with first degree murder and murder during the perpetration of a robbery, Ind. Code § 35-13-4-1 (Burns 1975). He was tried to a jury, and was acquitted of first degree murder and convicted of the felony murder charge. The trial court sentenced appellant to life imprisonment.
