Mr. JUSTICE JIGANTI delivered the opinion of the court:

A passenger van traveling on the Indiana toll road ran into the rear of a semitrailer truck. Three of the passengers in the van, Jean Vinke, her daughter Elizabeth Vinke, and her niece, Lyn Jozsa, were killed. Another of Jean Vinke's daughters, Mary Lou Vinke, suffered personal injuries.
