Defendant, Irene Jenkins, was charged with attempt murder and two counts of aggravated battery. A jury found her not guilty of attempt murder but was unable to reach a verdict on the aggravated battery charges. A mistrial was declared, and the State sought to prosecute her again on the aggravated battery charges. Defendant filed a motion to dismiss in which she argued that a retrial...
