Petitioner Jimmy Fain was found by a jury to be a habitual criminal under RCW 9.92.090. The trial court sentenced him to a term of life imprisonment pursuant to the statute, and he is currently serving that sentence in the state reformatory at Monroe. Following his conviction, he appealed his sentence to the Court of Appeals, asserting that, under the circumstances of his case, life in prison constitutes cruel...
