This appeal is made to a single judge of the Supreme Court of Nebraska pursuant to the provisions of Neb.Rev.Stat. § 29-824 (Reissue 1979). The appellee, Ruth King, was charged with a violation of Neb.Rev. Stat. § 28-416(3) (Reissue 1979) in that it is alleged she did feloniously, unlawfully, and knowingly or intentionally possess a controlled substance other than marijuana, to wit: phenobarbital.
