The defendant's motion to inspect the Grand Jury minutes raises the issue of whether a person can be charged with murder if he sets a fire in a dwelling and a fireman dies of a heart attack while fighting the fire.

A New York County Grand Jury has indicted the defendant for two counts of arson (second and third degrees) and one count of murder in the second degree. The charges relate to a fire in an apartment of a six-story building...
