Hawley and Terry Lee Gibney, jointly tried and convicted by a Berkshire County jury on indictments for perjury (G.L.c. 268, § 1), took their appeals pursuant to G.L.c. 278, §§ 33A-33G, and we transferred the cases here on our own motion.
