Joseph Fernandes Correia was indicted on September 28, 1977, for murder, arising out of his alleged participation in an attempted bank robbery, during which one Alphonse Puzan, a security guard, was shot and killed. Before trial he filed motions to suppress lineup and expected in-court identifications of him by three persons as a participant in the robbery.
