Respondent Real Party in Interest, Mickey Clifton (hereafter referred to as defendant) was charged in Maricopa County Superior Court No. CR-104871 with two counts of theft by false pretenses and one count of attempted theft by false pretenses in violation of A.R.S. §§ 13-661, -663, -671(A) and -1647.1 He was tried to a jury and on July 25, 1979, was found guilty on Count I, theft by false pretenses...
