Respondent James Joseph Daugherty was convicted in Kitsap County Superior Court on charges of second degree burglary and second degree theft. Division Two of the Court of Appeals reversed, holding that the trial court improperly denied Daugherty's motion to suppress evidence seized by the police at his home. State v. Daugherty, 22 Wn.App. 442,
