The defendant was found guilty by a jury on a charge of first degree murder and sentenced to life imprisonment.

On arraignment the defendant stood mute and a plea of not guilty was entered for him. The evidence at trial established that the 21-year-old defendant had been drinking during the day and evening of July 16, 1978.
