Ronnie Wayne Dutton was tried by the court below, sitting without a jury, upon an indictment charging him with possession of marijuana with intent to distribute. He was found guilty as charged, and his punishment was fixed at confinement in the penitentiary for five years, with execution of three years of the sentence suspended upon certain specified conditions.
