The defendant, Byron Turner, a/k/a Michael Whitmore, was tried by a jury and found guilty of delivery of heroin, MCL 335.341(1)(a); MSA 18.1070(41)(1)(a), and conspiracy to deliver heroin, MCL 750.157a; MSA 28.354(1).
