STATE v. MARTIN

No. 797SC922.

267 S.E.2d 35 (1980)

47 N.C. App. 223

STATE of North Carolina v. Ernest Lee MARTIN.

Court of Appeals of North Carolina.

June 17, 1980.

Attorney(s) appearing for the Case

Atty. Gen. Rufus L. Edmisten by Elizabeth C. Bunting, Asst. Atty. Gen., Raleigh, for the State.

Early & Chandler by John S. Williford, Jr., Rocky Mount, for defendant-appellant.

PARKER, Judge.

Defendant challenges on appeal the sufficiency of the evidence to support his conviction for armed robbery. Although the record does not reflect that defendant renewed his motion to dismiss at the close of all of the evidence, the provisions of G.S. 15A-1227(d) and G.S. 15A-1446(d)(5) allow him to raise this issue on appeal. State v. Alston, 44 N.C. App. 72, 259 S.E.2d 767
