The defendant, William B. Boles, Jr., was convicted and sentenced to a term of 35 years' imprisonment after a jury trial in the circuit court of Shelby County. The charge by information accused Boles of the murder of Cecil Durbin under section 9-1(a)(2) of the Criminal Code of 1961 (Ill. Rev. Stat. 1977, ch. 38, par. 9-1(a)(2)).
