The evidence in the case as presented at trial was that on October 31, 1979 at closing time three men entered the offices of Marden Creations, a small jewelry manufacturing concern owned by the deceased. One of the men, allegedly the defendant, announced a robbery. Shots were fired and the defendant ran to the back of the premises. The deceased called to his nephew to take out a licensed weapon he carried and shoot which the nephew...
