Defendant was convicted on his plea of guilty to the charge of second-degree murder. MCL 750.317; MSA 28.549. He was sentenced to a prison term of from 40 to 80 years and now appeals by right.

Prior to defendant's preliminary examination on an open charge of murder, defense counsel raised the question of defendant's competency to stand trial. It was agreed by all parties that the preliminary examination...
