On January 24, 1979, defendant Jay Howard Minier was convicted by Cheboygan County Circuit Judge Richard G. Boyce, sitting without a jury, of delivery of marijuana, MCL 335.341(1)(c); MSA 18.1070(41)(1)(c).1 He was sentenced to two years probation, plus costs of $240, and appeals as of right.
