The court below granted summary judgment for Defendant drug company (Upjohn) in a suit arising out of the personal injuries suffered by Plaintiff Cleon Richards (hereafter "Plaintiff" or "Richards"), which allegedly resulted from medical treatment with the drug neomycin sulfate, manufactured by Upjohn.
