Plaintiff, Pine-Wood Limited, brought this action in Oakland County Circuit Court to recover a $12,500 mortgage loan application fee. The trial court granted plaintiff's motion for summary judgment pursuant to GCR 1963, 117.2(2), finding that defendant had failed to state a valid defense to plaintiff's claim. Defendant now appeals that judgment as a matter of right.
