BUSSEY, Judge:

Appellant, Pedro (Pete) Perez, hereinafter referred to as defendant was charged, tried and convicted in the District Court of Texas County, Case No. CRF-78-65, for the offense of Attempted Robbery with a Dangerous Weapon in violation of 21 O.S.Supp. 1973, § 801. His punishment was fixed at ten (10) years' imprisonment and from said Judgment and Sentence an appeal has been perfected to...
