On July 29, 1976, the appellant, Jose Armando Rivera, Jr., pled guilty to an indictment charging him with possession of marijuana with the intent to distribute in violation of 21 U.S.C.A. § 841(a)(1). He was sentenced to a term of three years, with the condition that he be confined in a jail-type institution for a period of five months.
