Charles E. Sherman, plaintiff appellee, sued the City of Indianapolis and Eugene Gallagher, the Chief of Police, (hereinafter collectively referred to as the City), claiming he had been improperly reduced in rank within the Indianapolis Police Department by not having been afforded either notice of his demotion or a hearing. Sherman sought restoration to the rank of Technical Captain and the back pay which he lost due to the demotion. The City appeals...
