Laura and Edward Killebrew, husband and wife, filed a complaint in the Superior Court of Marion County to recover damages from Dr. Frank Johnson on a theory of medical malpractice. The Killebrews alleged that Dr. Johnson failed to exercise due care by failing to inform himself of the results of X-rays he ordered taken to determine the possible location of a Dalkon Shield, an intrauterine contraceptive device, (IUD) placed in Laura.
