BATJER, Justice:

This case involves the validity of an indemnity agreement whereby Nathan Jacobson and Bonanza No. 2 promised to pay to Clark County the amount of any condemnation award received by Ruth and Arby Alper for a parcel of land underlying Flamingo Road. We affirm the summary judgment in favor of Bonanza No. 1, Tracy Investment Co., J.J. Enterprises, and T.L. Corporation because they did not assume the obligation to indemnify the county...
