Defendant, Richard Michael Dowling, was indicted by a grand jury on charges that he "Did knowingly and intentionally produce a Schedule I Controlled Dangerous Substance, namely marijuana (R.S. 40:964(C)(10), Schedule I), contrary to L.R.S. 40:966(A)(1)." A jury tried and convicted Dowling of this offense. The trial judge sentenced him to three years imprisonment at hard labor, suspended the sentence and placed defendant...
