This case reaches us on an interlocutory appeal from an order of the Circuit Court of the Third Circuit denying defendant-appellant's motion to dismiss an indictment charging a violation of HRS § 710-1072.5, Obstruction of Justice.1 The indictment arose from his refusal to cooperate in a grand jury investigation of illicit gambling on the island of Hawaii.
