The appellant, Larry Leon Miller, was indicted by the grand jury of Tuscaloosa County for sodomy in the first degree, entered a plea of not guilty, was found guilty by the jury of sodomy in the first degree as charged in the indictment, and duly sentenced to be imprisoned in the penitentiary of the State of Alabama for a term of fifty (50) years, and appeals to this Court.
