This diversity action arises out of medical treatment — an appendectomy — performed by defendant Charles Bolinger on the plaintiff Delbert Baughman in 1964. There are two plaintiffs in this case. The suit of plaintiff Delbert Baughman is one for medical malpractice. Delbert claims that during the 1964 surgery defendant negligently left a surgical drain in plaintiff's body.
