Joe Pinkerton, also known as Joseph Allen Pinkerton, was convicted on one count of the sale of cocaine, § 20-2-70(a), Code of Alabama 1975, and punishment was fixed by the jury at a $12,500.00 fine, to which was added a fifteen year term of imprisonment by the trial court. Pinkerton does not on this appeal challenge the sufficiency of the evidence upon which he was convicted, nor did he do so at the trial level by either motion to exclude the State...
