IN RE THIES

No. 79-2218.

662 F.2d 771 (1980)

In re Winthrop Drake THIES, Appellant.

United States Court of Appeals, District of Columbia Circuit.

Decided October 24, 1980.

Attorney(s) appearing for the Case

Mark L. Perlis, Washington, D. C., for appellant.

R. Bruce Johnson, Atty., Dept. of Justice, Washington, D. C., with whom M. Carr Ferguson, Asst. Atty. Gen., Gilbert E. Andrews and William A. Friedlander, Attys., Dept. of Justice, Washington, D. C., were on the brief, for appellee.

Before BAZELON, Senior Circuit Judge, MIKVA and EDWARDS, Circuit Judges.

Opinion PER CURIAM.

PER CURIAM:

Appellant was disbarred by the United States Tax Court on August 9, 1979. The court relied exclusively on appellant's 1978 automatic disbarment from the New York State courts, which followed his 1976 felony conviction for assaulting a federal officer. The sole issue on this appeal is whether the Tax Court's exclusive reliance on the state disbarment was error.
