Petitioner seeks habeas corpus relief from his 1975 bench trial conviction in the Massachusetts Superior Court for unarmed robbery. Ciummei filed, but did not pursue, an appeal from that conviction. A subsequent application for sentence review was filed but later withdrawn. In 1977, he filed a petition for a writ of error challenging the voluntariness of his jury waiver.
