Clifford Kelly filed suit against Brady L. Tucker in the Circuit Court of Harrison County seeking personal injury and property damages. The trial court granted Kelly a peremptory instruction directing the jury to find for him. A verdict was returned for Kelly in the sum of two hundred nine dollars fifty-seven cents ($209.57) property damage.
