PADGETT, Judge.

This is an appeal from a judgment dismissing appellants' complaint which sought to enforce an alleged contract to make a will. The issue is whether the court below erred in finding as a matter of fact that it was not the intention of the parties to prevent the decedent from disposing of most of his estate during his life.
