DECISION AND ORDER

REYNOLDS, Chief Judge.

This is a suit for damages under 42 U.S.C. § 1983 arising out of the incarceration of the plaintiff for eight hours for civil ordinance violations. This court has jurisdiction pursuant to 28 U.S.C. § 1343(3) and (4).

The case was tried to a jury for three days beginning on July 29, 1980. On August 4, 1980, the jury returned a special verdict finding that (1) Thomas Baker was not liable to the plaintiff...
