Susan Giza became pregnant while taking the birth control pill "Modicon," which was manufactured by Ortho Pharmaceutical Corporation and was subsequently recalled from the market at the request of the Food and Drug Administration. She and her husband Andrew sued Ortho for "wrongful birth" in the Hampden County Superior Court in Massachusetts.
