The above entitled action arises from an incident wherein Jerry Dennis Johnson was killed when the tractor truck and trailer he was driving left the road and rolled over. This is the third case that has been filed in connection with the death of the decedent. See Johnson v. International Harvester Co., 487 F.Supp. 1176 (D.N.D.1980).
