DORIS, Justice.

The defendant, Eugene Bailey, was convicted of rape following a jury trial in the Superior Court. On appeal the defendant asserts that the trial justice erred in denying a motion to suppress certain evidence that had been obtained as a result of an unlawful entry into the defendant's apartment. Having determined that the trial justice should have suppressed the evidence, we reverse the judgment...
