On May 10, 1979, defendant Huey P. Beavers was charged with the crime of operating a motor vehicle while intoxicated, fourth offense, in violation of La.R.S. 14:98(E). He pleaded not guilty and was tried by a jury which delivered a verdict of guilty as charged. Defendant was thereafter sentenced to a term of imprisonment at hard labor for ten years.
