Plaintiff, E. F. Garrett, appeals the judgment of the district court rejecting his demand for damages allegedly caused by the illegal cutting of timber by the defendant, Martin Timber Company, Inc., on land which Garrett claims to possess as owner. We reverse and award plaintiff damages for the reasons assigned.
