This is an appeal from a summary judgment rendered in favor of Genevieve De Leon Page, plaintiff in the trial court, in a suit wherein plaintiff seeks to enforce certain provisions of a prior judgment by a partition of real property. The trial court ordered that the subject property be sold and that plaintiff receive 60% of the proceeds of sale and that Jose De Leon, defendant in the trial court, receive the remaining 40%.
