THOMPSON, Justice:

A grand jury indicted Kussman for attempted escape with use of a deadly weapon, extortion with use of a deadly weapon (three counts), and first degree kidnapping with use of a deadly weapon (three counts). Contending that insufficient evidence was produced before the grand jury to warrant indictment, he filed a petition with the district court for a writ of habeas corpus.
