OPINION

NYE, Chief Justice.

This is a suit to enforce an earnest money contract for the sale of certain realty located in Hidalgo County, Texas. The purchaser, A. R. Hudson, sued the seller, Walter J. Bach, Sr., for specific performance. Bach died. Upon his death, the administrator of his estate, Dr. Walter J. Bach, Jr., intervened and defended the cause thereafter.
