In March, 1979, an indictment was returned against Harold L. Francisco, charging him with three counts of willful failure to file an income tax return for the tax years 1972, 1973 and 1974, in violation of 26 U.S.C. § 7203. Francisco waived jury trial; his case was tried to the district court, the Honorable Donald E. O'Brien presiding, which found him guilty on all three counts.
