MERRITT, Circuit Judge.
The issue in this case is whether Carpenter's forced retirement under a pension plan at age sixty-one after thirty-one years of service with Continental Trailways violates the Age Discrimination in Employment Act of 1967, 29 U.S.C. § 621 et seq. ("ADEA" or "the Act"). After a bench trial the District Court held that Trailways violated the Act when it retired Carpenter because of his age.
