MORGAN, Judge.

Being convicted of arson under § 560.010, RSMo 1969, appellant appealed to the Eastern District of the Court of Appeals wherein his cause was submitted to a seven member panel thereof. A majority of four reversed the conviction because there was " . . . no evidence that the fire was communicated to any combustible part of the building, or that as the result of the fire there was any altering or destruction of any component part of the building...
