This negligence action arises out of an airplane crash on November 3, 1973 in Boston, Massachusetts. The owner and operator of the aircraft, Pan American World Airways, Inc. ("Pan Am"), commenced this action against the seller and manufacturer of the aircraft, The Boeing Company ("Boeing"), to recover damages for the loss of the plane.
