We withdraw our former opinion handed down on November 30, 1979, and substitute this one in its place which reaches the same result. The motion for rehearing is overruled.

Pamela Mary Bragdon instituted this action against Everett L. Bragdon, Jr. to recover past due support and maintenance payments. Mrs. Bragdon's cause of action is grounded on a separation and property settlement agreement made by the parties...
